Q:"We have a 'clear to close' and are ready to schedule a closing through Accurate Title.  What do we, as the Broker/Lender, need to do?"
 
A:Call Accurate Title at 330.830.1045 to schedule the closing.  This will allow ATASC to confirm closer availability, review the file and ensure everything is in order, i..e, updated payoffs, current tax information, etc.
  Brokers and Lenders will need to forward a "super fax" consisting of any documents the Broker/Lender needs signed at closing, a final 1003, the home owners declaration page w/agent name and number and the appraisal invoice. By sending this documentation early, phone calls can be made and correct information supplied to our Closing and HUD Preparation Department.
 
 
Q:"My Borrower is going through a divorce/dissolution, does the spouse need to sign closing documents and/or attend the closing?"

A:YES ~ As Ohio is a "dower State", until such time as the marital contract is terminated by a final Decree of the Domestic Relations Court, the spouse must sign any/all dower documents. 


Q:"My Borrower is unable to sign due to disability or illness, can a Power of Attorney be used?

A:YES ~ Most Lenders will allow a Power of Attorney to be used in place of the actual Borrower.  As this is up to the actual Lender, it is up to you, as the Loan Officer, to contact your Lender and ask what provisions must be made for using a Power of Attorney.

NOTE:  The ORIGINAL Power of Attorney must be received by ATASC prior to closing to ensure it meets recording and transaction standards as this document MUST be filed with the County Recorder as the document immediately prior to  the mortgage.
